Is Your Not-for-Profit Corporation Ready for ONCA?

Is your not-for-profit corporation incorporated in Ontario? This fall, on October 19, 2024, the Ontario Not-for-Profit Corporations Act (ONCA) takes full effect – and the three-year transition period to bring your corporation into compliance ends. If your corporation’s incorporating and governing documents do not have the new, ONCA-compliant provisions, they are deemed to be included on that date.
If you don’t know what these new rules are, please contact us and we can help to update your documents. If your corporation has charitable status, additional approval from the Public Guardian and Trustee and the Canada Revenue Agency may be required. If your corporation has already transitioned to ONCA, we recommend consolidating your corporation’s incorporating documents, by applying for restated articles.
